GENERAL TERMS OF USE

Article 1. User Acceptance

Use of the website "www.emanuelaborok.com" implies unconditional acceptance of these General Terms of Use (hereinafter "GTU") by any user wishing to access information about products provided by "EB DEZIGN". If the user does not agree with the GTU set out below, they must stop using the website. These GTU are binding throughout the entire period of use of the website. "EB DEZIGN" reserves the right to modify and/or update the GTU at any time and without prior notice. Access to and use of the website will be subject to the GTU in force at the time of such access and use.

Article 2. Legal Identification

The website "www.emanuelaborok.com" is owned by "EB DEZIGN", a limited liability company (SARL) with variable share capital of €1,000, registered office at 9 rue Rousselet, 75007 Paris, registered with the Paris Trade and Companies Register under number 853 577 799.

Article 3. Purpose

These GTU are intended to govern the use of the website "www.emanuelaborok.com" and to inform users about the personal data protection policy and cookie management.

Article 4. General Description of Services

The website allows the company to communicate about its identity and the characteristics of the products it provides, namely ready-to-wear clothing and fashion accessories. In this context, "EB DEZIGN" collects personal data through contact and sales forms.

Article 5. Availability

The company will use its best efforts to make the website accessible 24 hours a day, 7 days a week, subject to force majeure or events beyond the company's control, and except for interruptions, suspensions or limitations in connection with maintenance operations and/or updates necessary for the proper functioning of the website. The company is only bound by a best-efforts obligation regarding the accessibility, operation and availability of the website or its content.

Article 6. Member Area

6.1. Registration

To use the Services, the User must register by following the registration process provided on the Platform. To do so, the User must provide the following information in good faith: First name, Last name, Email address, Password, Mobile phone number.

The User is invited to read the GTU and accept them. By clicking, the User acknowledges having read and understood the GTU and fully accepts all their provisions without restriction or reservation. Once registered, the Member may complete their profile by providing their postal address.

The Member agrees to provide and maintain accurate, up-to-date and complete information. "EB DEZIGN" shall under no circumstances be held liable for any difficulty in accessing the Platform due to incorrect or incomplete information. Pursuant to Article L223-2 of the French Consumer Code, the User is informed of their right to register on the telephone marketing opt-out list.

6.2. Personal Access Code

Once registration is complete and the Member Area validated, the Member receives a Personal Access Code. The Member is obliged to keep their Personal Access Code confidential. The Member is prohibited from transferring, lending or sharing their Personal Access Code with any third party or allowing any third party to log into their account.

6.3. Access to the Member Area

The Member will access their Member Area by identifying themselves with their email address and password. From their Member Area, the Member has access to the various Services offered by "EB DEZIGN". In the event of any change to their personal information, the Member undertakes to update the information provided in their Member Area accordingly.

6.4. Responsibility for Login Credentials

Each Member is obliged to keep their login credentials (username, password) confidential. The Member is responsible for all uses thereof. The Member is prohibited from transferring, lending or sharing their login credentials with any third party or allowing any third party to log into their Member Area.

Article 7. Intellectual Property

The website and all its content are protected by intellectual property rights (trademarks, designs, and all other existing and future intellectual property rights, whether French or international), and belong to the company or to third parties who have authorised the company to use them. All graphic elements such as information, texts, images, photographs and logos are protected by applicable laws. They may not under any circumstances be used, reproduced, imitated or adapted without the prior written authorisation of the company.

Article 8. Liability – Warranty

The company undertakes to comply with the principles of personal data protection, to inform individuals of their rights of access, rectification and objection, and to fulfil all legal and/or regulatory formalities. The user is solely responsible for the integrity, accuracy and quality of the data they enter in online forms. Access to and use of the website is entirely at the user's own risk.

Article 9. Personal Data

Pursuant to Law No. 78-17 of 6 January 1978 as amended by Law No. 2018-493 of 20 June 2018, the personal data requested is necessary to contact you, manage payment for products or services, handle any returns and information requests. This data may be shared with the company's partners responsible for order fulfilment.

The user has a permanent right of access, modification, rectification, objection, portability and restriction of processing with regard to information concerning them, by contacting the company at contact@emanuelaborok.com. In the event of a complaint, the user may lodge a complaint with the CNIL (French Data Protection Authority).

Article 10. Hyperlinks

The website may contain hyperlinks to websites operated by third parties. The company accepts no responsibility for the content provided on these third-party sites. If the user decides to visit a third-party site, they do so at their own risk.

Article 11. Cookie Management

When you browse our website, information relating to your browsing may be recorded in "Cookie" files installed on your computer, tablet or smartphone. Cookies are used to retain login information, provide a secure connection and collect statistics in order to optimise the website's features. Article 12. Breach

Any breach of these GTU entitles "EB DEZIGN" to refuse access to its services to the user responsible for the breach. The following are strictly prohibited: engaging in illegal or fraudulent activities, breaching public order, unauthorised access to computer systems, sending unsolicited emails, and any conduct likely to interrupt or harm the proper functioning of the website.

Article 13. Complaints

Any complaint must be sent to the company's registered office together with a copy of a valid identity document, either to the postal address indicated above or by email to: contact@emanuelaborok.com.

Article 14. Hosting Liability

The website "www.emanuelaborok.com" is hosted on the Shopify platform. "EB DEZIGN" shall not be held liable for any interruption, breakdown, technical malfunction or unavailability of the website resulting from a failure attributable to Shopify or any other third-party technical service provider. In the event of a service interruption related to the hosting provider, the company undertakes to inform its users as soon as possible and to make every effort to restore access to the website as quickly as possible.

Article 15. Language and Applicable Law

The language of the contract is French. The law applicable to the contract is French law.
